  • The business of sham applications

The term „AGG-hopping“ refers to a scam that is increasingly causing concern for companies: as the Mirror reports, people apply specifically for job advertisements that may contravene the General Equal Treatment Act (AGG) in order to claim compensation should their application be rejected – without, however, having any genuine interest in being hired.

The AGG serves an important purpose: it is designed to protect job applicants from discrimination on the grounds of age, gender, ethnic origin, disability or sexual identity, and provides for compensation payments. Most recently, the Hamm Labour Court dismissed a claim brought by an „AGG hopper“ (Haufe.de). Landmark rulings by the Federal Court of Justice and the European Court of Justice had already made it clear that, in order to be eligible for compensation under the AGG, there must be a genuine interest in the job.
